1. These terms

These terms govern your use of aepalletsales.com and any order you place with A&E Pallet Sales. Placing an order means you accept them. We may update them, and the version in force is the one published here on the day you order.

2. Who can buy

You must be at least 18 years old and legally able to enter into a contract. Our merchandise is sold for business and resale use. We do not require a resale certificate to buy, but any sales tax obligation arising from your resale is yours.

3. Product information and availability

Every load is a one-off. Listings describe load class, condition and an approximate count, and stock is removed when it sells. We reserve the right to withdraw a listing at any time before an order is accepted.

4. Price errors

Prices are shown in United States dollars and include shipping. If a listing carries an obvious pricing or description error, we may decline or cancel the order and refund it in full rather than fulfil it at the incorrect price. We will always tell you why.

5. Orders and payment

An order is an offer to buy. It becomes a contract when we accept it and take payment. We accept Bank Transfer (Wire or ACH) and Zelle. Both are manual: the order is placed first, it goes on hold, and the transfer details are emailed to you afterwards. Your load is held for 72 hours from the time the order is placed. If cleared payment has not arrived by then we may release the load back to the floor.

6. Condition and manifests

All merchandise is sold unmanifested. No itemised manifest is provided, and none is available on request. Stated unit counts are approximate ranges, goods are untested unless the listing states otherwise, and condition is described honestly on each listing. Retailer names identify the source of the merchandise only and imply no affiliation with, or endorsement by, that retailer.

7. Shipping, title and risk

Shipping is free to all fifty states and included in the price. Dispatch is within 2 business days of cleared payment. Title and risk of loss pass to you on delivery to the address you gave us. Inspect the load and note any damage on the bill of lading before signing, as set out in the shipping policy.

8. Returns

Covered claims only: damaged in transit, defective, or materially not as described. Change-of-mind returns are not accepted. Full terms, windows and the claims procedure are in the returns policy, which forms part of these terms.

9. Warranty

A&E Pallet Sales gives no product warranty of its own. Manufacturer warranties, where they exist, are claimed directly with the manufacturer. See the warranty policy.

10. Your obligations as a reseller

You are responsible for how you describe, test and sell what you buy from us, and for complying with the law and with any marketplace rules that apply to your sales. You may not represent yourself as an agent, dealer or authorised representative of A&E Pallet Sales or of any brand whose goods appear in a load.

11. Limitation of liability

To the fullest extent permitted by law, our total liability arising from any order is limited to the amount you paid for that order. We are not liable for lost profits, lost resale value, or any indirect or consequential loss. Nothing here limits liability that cannot lawfully be limited.

12. Governing law

These terms are governed by the laws of the State of Texas. Any dispute will be brought in the state or federal courts sitting in Dallas County, Texas, and both parties submit to that jurisdiction.
